These Terms and Services ("Terms") govern the use of the Kiwi Camera Smith website and the purchase of products from Kiwi Camera Smith ("we", "us", "our"). By accessing this website or purchasing any products, you agree to be bound by these Terms.

Kiwi Camera Smith operates as an online retailer specialising in vintage cameras, lenses, and associated photographic equipment ("Products"). All Products are sold primarily as second-hand, vintage, or used items unless explicitly stated otherwise.
2. Product Condition and Descriptions
2.1 Products are described as accurately as reasonably possible, including known faults, cosmetic wear, or functional limitations.
2.2 Due to the age and nature of vintage photographic equipment, Products may show signs of prior use, wear, or ageing that do not affect basic functionality unless otherwise stated.
2.3 Product photographs form part of the description. Minor variations in appearance may occur due to lighting, screen calibration, or age-related changes.
3. Pricing and Payment
3.1 All prices are listed in New Zealand Dollars (NZD) unless otherwise specified.
3.2 Prices do not include shipping costs, customs duties, import taxes, or clearance fees unless explicitly stated.
3.3 Payment must be made in full before Products are dispatched.
4. Shipping and Delivery
4.1 Shipping timeframes are estimates only and are not guaranteed.
4.2 Kiwi Camera Smith is not responsible for delays, losses, or additional costs incurred due to:
Customs inspections or clearance processes
Import duties, taxes, or fees
Carrier delays, errors, or service disruptions
Incorrect shipping information provided by the customer
4.3 Any additional costs incurred after dispatch, including customs fees, storage fees, or return shipping costs, are the sole responsibility of the customer.
5. Risk and Ownership
5.1 Risk of loss or damage passes to the customer upon dispatch of the Product.
5.2 Ownership transfers once full payment has been received.
6. 30-Day Quality Guarantee
6.1 All Products are covered by a 30-day quality guarantee from the date of delivery, unless explicitly stated otherwise in the Product listing.
6.2 The guarantee covers faults that were present at the time of sale and affect the basic operational functionality as described.
6.3 The guarantee does not cover:
Damage caused by user error, misuse, improper handling, or incorrect operation
Damage caused by incorrect loading of film, batteries, or accessories
Damage caused by attempted repairs, disassembly, or modification
Normal wear and tear, cosmetic deterioration, or age-related failure
Issues disclosed in the Product description prior to purchase
6.4 Kiwi Camera Smith is not responsible for damage caused by user error, even if it occurs within the 30-day period.
6.5 Proof of purchase and reasonable evidence of the fault may be required.
7. Returns and Refunds
7.1 Returns are accepted only where a valid claim is made under the 30-day quality guarantee.
7.2 Refunds or replacements are issued at the discretion of Kiwi Camera Smith after inspection.
7.3 Shipping costs, customs fees, import taxes, and associated charges are can only be refunded at the discretion of Kiwi Camera Smith.
7.4 The customer is responsible for all return shipping costs unless agreed otherwise in writing.
8. Limitation of Liability
8.1 To the maximum extent permitted by law, Kiwi Camera Smith is not liable for indirect, incidental, or consequential losses, including loss of data, film, images, or commercial opportunity.
8.2 Liability is limited to the purchase price of the Product.
9. User Responsibility
9.1 Customers are responsible for ensuring Products are suitable for their intended use.
9.2 Customers are expected to have appropriate knowledge of vintage photographic equipment operation and care.
10. Consumer Law
10.1 These Terms are intended to be read subject to the Consumer Guarantees Act 1993 where applicable.
10.2 If Products are purchased for business purposes, the Consumer Guarantees Act 1993 does not apply to the fullest extent permitted by law.
11. Privacy
Personal information is handled in accordance with the Privacy Act 2020 (New Zealand) and is used solely for order fulfilment and customer communication.
12. Amendments
Kiwi Camera Smith may amend these Terms at any time. Updated Terms take effect once published on the website.
13. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes are subject to the jurisdiction of New Zealand courts.
